Leomart Terms and Conditions

Welcome to Leomart. These Terms and Conditions (“Terms”) govern your use of our services, including website design, WhatsApp Cloud API integration, Bulk SMS, Virtual Top-Up, email marketing, CAC registration, digital marketing, and real estate services in Nigeria. By engaging our services or using our website, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By accessing or using any Leomart services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please do not use our services.

2. Services Overview

Leomart offers the following services:

  • Professional website design and development
  • WhatsApp Cloud API integration and support
  • Bulk SMS services
  • Virtual Top-Up (mobile airtime/data recharge)
  • Email marketing campaigns and management
  • Corporate Affairs Commission (CAC) business registration assistance
  • Digital marketing solutions including SEO, social media management, and advertising
  • Real estate brokerage and advisory services within Nigeria

3. Service Usage and Eligibility

  • You must be at least 18 years old or have legal authority to enter into binding contracts to use our services.
  • You agree to provide accurate, current, and complete information during registration and service use.
  • You are responsible for maintaining confidentiality of your account credentials and any activities under your account.

4. Payment and Fees

  • Pricing for our services will be communicated before commencement and are subject to change with prior notice.
  • All payments must be made in Nigerian Naira (₦) or as otherwise agreed.
  • Virtual Top-Up and Bulk SMS services may require upfront payment or pre-funding.
  • Failure to pay may result in suspension or termination of your access to services.

5. Intellectual Property

All content, trademarks, logos, designs, software, and materials provided by Leomart remain the exclusive property of Leomart or its licensors. You may not reproduce, distribute, or create derivative works without express written permission.

6. Customer Responsibilities

  • You are responsible for compliance with all applicable laws in Nigeria related to your use of our services, including data privacy, spam regulations, and intellectual property rights.
  • For Bulk SMS and WhatsApp messaging, you must ensure you have obtained necessary consents from message recipients.
  • You shall not use our services for unlawful, fraudulent, or malicious activities.

7. Service Availability and Limitations

Leomart will endeavor to provide continuous and reliable service but does not guarantee uninterrupted access. We reserve the right to suspend or terminate services for maintenance, upgrades, or violations of these Terms. We disclaim liability for any damages resulting from service interruptions or data loss.

8. CAC Registration Services

Leomart assists with business registration at the Corporate Affairs Commission but does not guarantee approval or timelines. You agree to provide accurate information and necessary documentation. Leomart is not responsible for delays or rejections by government agencies.

9. Real Estate Services

Our real estate services are advisory and brokerage only. You should conduct your own due diligence before any property transactions. Leomart is not responsible for property valuations, titles, or legal issues.

10. Privacy and Data Protection

We collect and process personal data as described in our Privacy Policy. You consent to data collection necessary for service delivery and communications.

11. Limitation of Liability

To the fullest extent permitted by law, Leomart, its affiliates, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of our services. Our total liability under these Terms is limited to the amount you paid for the relevant service.

12. Indemnification

You agree to indemnify and hold harmless Leomart and its affiliates from any claims, damages, liabilities, or expenses arising out of your use of services, violation of these Terms, or infringement of third-party rights.

13. Termination

  • Either party may terminate the service agreement with prior notice as agreed.
  • Upon termination, all outstanding fees become payable immediately.
  • We may suspend or terminate access without notice if you breach these Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.

15. Changes to Terms

Leomart reserves the right to update or modify these Terms at any time. We will notify you of significant changes via email or website notice. Continued use of services constitutes acceptance of the updated Terms.
